1. Acceptance of Terms
By accessing or using the Komiun platform, website, or mobile application ("Services"), you agree to be bound by these Terms of Service. If you are using the Services on behalf of a company, you represent that you have authority to bind that company to these terms.
2. Description of Service
Komiun is a coordination platform for shared staff transportation. We connect companies, employees, and transport providers through digital tools. Komiun does not own vehicles, employ drivers, or operate as a transportation company. We are a technology platform that facilitates the coordination of commuter transport services.
3. User Accounts
To use our Services, you must create an account. You are responsible for:
- Providing accurate and complete registration information
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
4. Token System
Komiun operates on a token-based model:
- Companies purchase tokens via credit card through the platform
- Each standard trip consumes one (1) token
- Out-of-city trips may require additional tokens based on distance
- Tokens are non-refundable once purchased
- Tokens are assigned to company employee accounts
- Unused tokens do not expire but may be subject to periodic review
5. Booking and Cancellation
- Trips can be booked between 72 hours and 4 hours before departure
- Cancellations made more than 4 hours before departure will refund the token
- No-shows or late cancellations will result in token deduction
- Recurring bookings can be set up and canceled through the app
6. Responsibilities
Company Responsibilities
Companies must ensure that only authorized employees use the platform and maintain adequate token balances for their team's transportation needs.
Employee Responsibilities
Employees must be at the designated boarding point at the scheduled time and follow all safety regulations during transit.
Transport Provider Responsibilities
Transport providers must operate vehicles in compliance with all applicable Mexican transportation laws and regulations, maintain proper insurance, and ensure all drivers are properly licensed and verified.
7. Limitation of Liability
Komiun acts as a coordination platform and is not liable for:
- Delays or disruptions caused by traffic, weather, or road conditions
- Actions or omissions of transport providers or their drivers
- Loss of personal property during transit
- Service interruptions due to technical maintenance
8. Governing Law
These Terms are governed by the laws of Mexico. Any disputes arising from these Terms shall be resolved in the courts of Puebla, Puebla, México.
